Judge “inclined” to throw Mariah Carey 'All I Want For Christmas Is You' case out

US District Court Judge Mónica Ramírez Almadani is reportedly feeling inclined to dismiss the case laid against Mariah Carey regarding her hit single, 'All I Want For Christmas'.

Mariah Carey is currently engaged in a legal battle after country singer Andy Stone, who performs under the stage name Vince Vance, filed a complaint last November stating that 'All I Want For Christmas Is You' infringed the copyright of his 1989 song under the same name.

The complaint was filed in a Los Angeles federal court. 

“If you look at both songs, you can see that about 50 per cent of the words are the same, in almost the same order. I think it’s a pretty strong claim,” the plaintiff’s lawyer, Douglas M. Schmidt, previously said, according to NME

In the latest Rolling Stone report published on Thursday, November 7, US District Court Judge Mónica Ramírez Almadani reportedly said she was leaning towards dismissal of the lawsuit. 

This is after Carey's lawyer argued in the California courtroom that the claims are unfounded and should be dismissed.

Andy's song was released in the late 1980s, while Carey's followed in 1994. 

This is not the first time the complaint was filed. The same artist filed the same charge in 2022, but it got dropped.
