Mariah Carey's lawyers file a motion to dismiss the lawsuit against her

Mariah Carey's attorneys argue that the singer did not copy her hit single, 'All I Want For Christmas', from a group called Vince Vance and the Valiants.

Mariah Carey's legal battle for 'All I Want For Christmas' continues...

In the latest developments, the singer's legal team have disputed claims that the singer's hit single, 'All I Want For Christmas' was copied from a group called Vince Vance and the Valiants. 

BBC reports that 'In November, songwriter Vince Vance (real name Andy Stone) filed a second lawsuit against Carey accusing her of copyright infringement, arguing that her 1994 smash “was a greater than 50% clone…in both lyric choice and chord expressions” of his 1989 song of the same name, which was performed by his group Vince Vance and the Valiants'.

This week, Carey's attorneys reportedly filed a motion to dismiss the lawsuit. They argued that the songs share nothing but 'commonplace musical building blocks'.

This is after the copyright infringement lawsuit stated that the two songs share a “unique linguistic structure”.

“Plaintiffs’ claimed similarities between Vance and Carey are unprotectable…because they are, among other things, fragmentary and commonplace building blocks of expression that Vance and Carey use differently in their overall different lyrics and music,” Carey's attorney's filing reads.

Carey's song is one of the biggest songs ever released. 

In 2023, the song made it onto the National Recording Registry. The US government website explained that 'these recordings are not necessarily selected as the “best” recordings of all time, but rather as works of enduring importance to American culture'.  

During the same year, the classic made it to #1 on Billboard Hot 100

It was the fourth consecutive year that the song took the #1 spot on the charts. The first time the song hit the Hot 100’s top 10 was in December 2017.
