The five accused appeared in the Durban Magistrate’s Court on Friday morning.

Lindokuhle Thabani Mkhwanazi (30), Lindani Zenzele Ndimande (35), Siyanda Eddie Myeza (21), Mziwethemba Harvey Gwabeni (36) and Lindokuhle Lindo Ndimande (29), are charged with conspiracy to commit murder, unlawful possession of a firearm, unlawful possession of ammunition, and five counts of attempted murder.

The state has also added two further charges of money laundering.

National Prosecuting Authority spokesperson Natasha Ramkisson-Kara says indictments have been issued to the accused.

"The state served an indictment on the accused through their counsel, and the case was remanded to 8 May 2025 for the accused to make their first appearance in the Durban High Court."

Forbes and Motsoane were shot and killed outside a restaurant on Florida Road in Durban almost two years ago.

In the previous court hearing, Gwabeni and Ndimande told the court that the ongoing extradition of the two other accused, the Ndimande brothers from eSwatini, also delayed the case.

They said even though the state claims the investigation is complete, the matter has not been moved to the high court.

"It is a fact that this matter is still in the district court roll, but it is common knowledge to anyone involved in this matter or anyone who is following this matter that as of the 29th of November 2024, the state placed on record that the application for postponement for the indictments to be served to the accused,” said Magistrate Vincent Hlatshwayo.
