Chief Justice Mogoeng files appeal against ‘superficial, flawed’ JCC ruling
Updated | By Martine van der Walt Ehlers
Chief Justice Mogoeng Mogoeng has filed an appeal against an order for him to retract remarks that he made on Israel during an online seminar in 2020.
In March, the Judicial Conduct Committee (JCC) found Mogoeng guilty of misconduct and ruled that the head of the judiciary must issue a public apology.
Mogoeng argues that the reasoning behind the JCC's decision is superficial and flawed.
The head of the judiciary was taken to task by several lobby groups, following sentiments shared during the June 2020 webinar.
Mogoeng lamented what he believed to be South Africa’s lopsided attitude towards the Israel-Palestinian conflict.
He added that the country’s history of forgiveness and understanding should inform its approach to peace-making in the Israel-Palestinian conflict.
In his lengthy appeal, Mogoeng argues that Judge Justice Mojapelo failed to interpret the Code of Judicial Conduct.
