Gauteng Health heads to SCA over medical waste tenders

The Gauteng Health Department has welcomed a ruling by the High Court in Johannesburg granting it leave to appeal a previous ruling on medical waste tenders.
On Friday, the High Court granted the department the go-ahead to appeal a judgment that set aside medical waste tenders awarded to two service providers worth over R500 million.
The Department of Health in the province had awarded Tshenolo waste a R314 million contract to collect and dispose medical waste in Johannesburg and the Tshwane.
In addition, Phuthing Medical Waste Management was awarded R211 million to do the same work in the West Rand, Sedibeng and Ekurhuleni.
In November 2023, Buhle Medical Waste applied for an urgent application at the Johannesburg High Court to interdict the two waste companies from starting their services pending the outcome of a review of the decision to award them the contracts.
Judge Ahmed Cajee said in his ruling on Friday that the Gauteng health department had made a strong case for leave to appeal to the Supreme Court of Appeal.
"The Gauteng Department of Health (GDoH) is pleased with the ruling made by the Johannesburg High Court on Friday, 01 March 2024, concerning the medical waste tender dispute involving Buhle Waste,” said the department’s Motalatale Modiba.
"A significant aspect of this decision is the Court's dismissal of Buhle Waste's application, along with the imposition of costs.”
