Magudumana back in court to challenge ‘unlawful’ arrest, deportation

An urgent application by Dr Nandipha Magudumana to declare her arrest and deportation from Tanzania unlawful is set to return to court on Thursday.

The Free State High Court in Bloemfontein postponed the matter on Friday to allow respondents to file replying affidavits.
Home Affairs Minister Aaron Motsoaledi has officially been joined as the sixth respondent in the matter.
Magudumana was arrested in Arusha, alongside prison escapee Thabo Bester, in April where authorities suspect the couple were heading for the border between Tanzania and Kenya.
However, her legal team is arguing that her arrest was unlawful and without merit.
Magudumana and six others are facing charges relating to Bester’s daring escape from the Mangaung Correctional Centre in May last year.
Judge Philip Jacobus Loubser granted lawyers for the South African Police Service and the National Prosecuting Authority until 26 May to file their answering papers.
The Department of Home Affairs had until Monday to file the opposing papers.
The NPA has already indicated its intention to oppose Magudumana's application.
